Another on Texas’ ‘Most Wanted’ criminal alien list arrested

Fabian Martinez Toribio, a 25-year-old Mexican citizen illegally in the U.S., was captured on July 31 in the Austin suburb of Round Rock, Texas.

Through investigative work and a series of leads, members of Texas Department of Public Safety Criminal Investigations Division and U.S. Marshals Lone Star Fugitive Task Force found and arrested him.

Martinez Toribio has a criminal history. In April 2018, under the Trump administration, he was first apprehended after illegally entering the country from Mexico. He was arrested and convicted of entry without inspection and removed from the U.S.

Migrant Accused Of Raping 15-Year-Old Released On $500 Bail

Haitian migrant charged with the rape of a 15-year-old girl at a Massachusetts hotel was released on $500 bail last week despite ongoing requests by Immigration and Customs Enforcement (ICE) to transfer him to its custody.

Cory Alvarez, a 26-year-old Haitian national who was allowed into the U.S. via a controversial parole program that allows up to 30,000 migrants to fly in each month, was charged with aggravated rape of a child in March.

ICE said in a statement that Boston’s branch of Enforcement and Removal Operations (ERO) filed a detainer against Alvarez with the local sheriff’s office March 14. A detainer is a request by which authorities alert ICE about an individual they believe to be subject to deportation so they can take the individual into federal custody and deport that person.

In this case, as in many “sanctuary” jurisdictions, the detainer was not adhered to, and Alvarez was released on bail.

“On June 27, Plymouth Superior Court refused to honor ERO Boston’s immigration detainer and released Alvarez from custody on a $500 bond,” ICE Boston ERO spokesperson James Covington said.

Blue County Released Illegal Migrant Rapist After Ignoring ICE Detainer

Law enforcement officials in Charles County, Maryland, released a convicted rapist living unlawfully in the country after ignoring a request to hand him over to deportation officers and suspending nearly his entire 20-year prison sentence.

Immigration and Customs Enforcement (ICE) agents arrested Henry Argueta-Tobar, a 19-year-old Guatemalan national living in the U.S. illegally, on Wednesday in Waldorf, Maryland, the agency confirmed in a press release. Deportation officers were able to nab Argueta-Tobar after local officials allegedly refused to cooperate on requests to transfer him into their custody.

Illegal border crossings surpass 12.5 million since Biden-Harris took office, most in US history

U.S. Customs and Border Protection released monthly border apprehension data on Friday, saying, “statistics show lowest southwest border encounters in nearly four years.” CBP also claimed illegal border crossings were down by 34% from June to July and the drop is due to a presidential proclamation issued in June.

Troy Miller, a senior official performing the duties of the CBP Commissioner, said recent Biden-Harris policies led “to the lowest number of encounters along the southwest border in more than three years.”

Despite these claims, the total number of apprehended illegal border crossers surpassed 10.5 million in July with two months left in the fiscal year, which ends Sept. 30.

How a Migrant Accused of Rape Was Freed and Charged With Rape Again

For 15 months, Daniel Davon-Bonilla sat in the Rikers Island jail complex in New York City, accused of raping a transgender woman in a migrant shelter.

Then, on June 24, Mr. Davon-Bonilla stood before a judge in a Brooklyn court. The victim in the case had refused to testify, and now prosecutors were offering him a deal: He could plead guilty to a felony assault charge and be released that day.

The judge, Donald Leo, warned Mr. Davon-Bonilla, a 24-year-old from Nicaragua, that he could be deported.

“Do you still wish to proceed with your plea of guilty?” asked Justice Leo, according to a transcript of the hearing.

 

“Of course,” Mr. Davon-Bonilla replied.

In fact, the federal Immigration and Customs Enforcement agency, known as ICE, had informed the city that it intended to deport Mr. Davon-Bonilla when he was first charged with rape, the agency said. But neither the city nor the Brooklyn district attorney notified federal officials when he was released that day in June.

Arizona migrant busing continues as feds send nearly $50 million more in aid

Over $47 million in federal taxpayer dollars is going toward service programs in Arizona as the state continues to facilitate migrant requests for transportation to other parts of the country, albeit fewer than before. 

The funds are part of $380 million in supplemental funds for the Federal Emergency Management Agency and United States Customs and Border Protection for the Shelter and Services program, which a news release states is used for "food, shelter, clothing, acute medical care, and transportation to noncitizens" that are waiting for their immigration court date in the U.S. 

Gov. Katie Hobbs told The Center Square at a media availability on Thursday that migrant busing to one's desired location continues to play a critical role in managing the crisis. 

 

"When it comes to community safety... avoiding unsheltered street releases of migrants is a critical, critical piece of that," Hobbs said, adding that the state has done a successful job of not doing street releases so far.

"We're going to continue deploying those funds to ensure that folks get processed, they get to their destination, which usually is not in Arizona," she continued, adding that a "complete shutdown" of services in Pima County was possible without the new round of funding. :snip:

Migrants flooding NYC’s justice system — making up ‘75% of arrests in Midtown’ — as ‘pathetic’ sanctuary city laws handcuff cops

Jefferson Maldenado, a 31-year-old migrant from Ecuador, has been arrested in New York City five times since arriving in the US earlier this year.

His latest bust was for stealing a pair of pants and a beer from the Target near Herald Square.

Asked why he committed the crime, the migrant thief said, “I wanted to change my clothes and think.

17 Illegal Immigrants Found in 'Cloned' Home Improvement Box Truck Near Del Rio, Texas

Clever...but not clever enough. A Mississippi man was arrested by the Texas DPS Friday after they discovered that the "Lowe's" box truck he was driving had a hidden compartment in which 17 illegal immigrants were being smuggled. 

Cezanne Megel Patterson, 28, of Jackson, Mississippi, was arrested and charged with human smuggling with the likelihood of serious bodily injury or death.

The DPS said in a press release that one of its troopers conducted a traffic stop on what appeared to be a Lowe’s Home Improvement store delivery truck outside of Del Rio, Texas, on US-277, near the southern border during the early morning hours on Friday.

After stopping the truck, the trooper interviewed Patterson and noticed he was demonstrating "strange behavior" and had multiple discrepancies with his travel itinerary, including expired tags on the truck, DPS said.

Patterson consented to a search of the truck, and when troopers went inside the cargo area, they found a false compartment toward the front.

Using crowbars and other tools, the troopers opened the compartment and found 17 illegal immigrants crammed inside the 3-foot-wide space, which lacked ventilation.

Florida sues over violent foreign nationals being released from prison into US

(The Center Square) – The state of Florida is suing the Biden-Harris administration to obtain information on how many illegal foreign nationals convicted of violent crimes who served time in prison were released into the U.S. instead of being deported.

“Historically, when illegal aliens were brought to the U.S. to be prosecuted for their crimes, it was well understood that the aliens would be deported once they have served their sentence,” Florida’s lawsuit, filed by Attorney General Ashley Moody, states. “That was until the Biden-Harris Administration implemented their shockingly irresponsible immigration policy, pushing unknown numbers of dangerous criminals straight from federal prison into our communities and causing chaos, anarchy, and crime.”

 

The lawsuit was filed after Florida received no response to a Freedom of Information Act request it submitted in March seeking information about criminal illegal foreign nationals allegedly being released into the U.S. instead of being deported.

 

It was filed in the U.S. District Court Middle District of Florida Fort Myers Division and names U.S. Immigration & Customs Enforcement and the Federal Bureau of Prisons as defendants.

“In addition to flat out refusing to secure the border, reports indicate that President Biden and failed Border Czar Kamala Harris refuse to deport dangerous illegal immigrant prisoners into our communities once they are released from prison,” Moody said. “This administration has made it clear they will not turn over documents showing this dangerous and unlawful scheme in a timely manner. Now, American cities are suffering in a very public way. I will not stand idly by and allow this dereliction of duty.”

When filing the FOIA request in March, she said, “The Biden administration has full knowledge that prisoners from other countries are making their way into the United States through our wide-open border. Now, we are demanding to know reasons why the Biden administration is releasing criminal illegal aliens in U.S. prisons directly into the interior, rather than deporting them back to their country of origin,” saying, “the American people deserve to know.”

Grassley presses HHS, DHS for more info on 'failure to protect' over 291,000 unaccompanied migrants

Sen. Chuck Grassley (R-Iowa) is requesting documents and data from the U.S. Departments of Health and Human Services (HHS) and Homeland Security (DHS) "regarding their documented failure to protect over 291,000 unaccompanied migrant children," according to a news release sent out on Wednesday

 

A watchdog report published on August 19 found that DHS hasn't accounted for all UCs sponsors or attempted to locate those who did not attend their scheduled proceedings.

Grassley's office said that the Biden-Harris administration "terminated a Trump administration policy that enhanced critical HHS and DHS information-sharing," which has resulted in "broken inter-agency communications channels" and fued the migrant children crisis.

“[The HHS Office of Refugee Resettlement (ORR)]’s lax vetting has placed migrant children in grave danger of exploitation and abuse and makes locating these children after placement difficult, something I fear hinders the work of DHS as well,” Grassley wrote in a letter. “I won’t tire in my commitment to protect these children and bring about needed reforms to ensure they aren’t placed in the hands of traffickers and those seeking to exploit them.”
